South Jersey's Dream Course - Prize Descriptions and Official Rules
Prize description:
Two winners will be chosen in a random drawing from the 18 essays judged to be finalists. Winners will join a Courier-Post reporter and play all 18 holes listed in the editors' version of the "Dream Course". Limousine service, food and beverages will be provided by the newspaper. Winners must agree to play on a specific date and allow their names and photos to be used in a story.
South Jersey's Dream Course Official Rules: No purchase necessary. Federal, state, local and municipal laws and regulations apply. Void where prohibited.
Eligibility: South Jersey's Dream Course (Sweepstakes) is open to U.S. Residents, (excluding Puerto Rico), 18 years or older at the time of entry. Employees of the Gannett Co., Inc and each of its respective affiliated subsidiaries, companies or agencies, and the immediate family members of, and any persons domiciled with such employees, are not eligible.
Entry: The Sweepstakes will begin at 12:01 am (E.S.T.) on July 11, 2002 and all entries must be received by 11:59 pm (E.S.T.) on Sunday, July 31, 2002 (Sweepstakes Period). Enter South Jersey's Dream Course by completing all of the required information and following all instructions on the official entry form to which you have been linked. Submit your entry by clicking on the "SUBMIT" button. There are no other means of entry available. Sponsor will not be responsible for incomplete, lost, or late entries or for the failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with the sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email by the Internet access provider, online service provider or the organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.
Readers are invited to submit essays of 25 words or less describing the "best" holes on South Jersey's public courses. "Best" can be defined by a combination of attributes such as (but not limited to) uniqueness, difficulty, or scenic beauty. Editors of the Courier-Post will choose 18 "finalist" essays describing the "best" holes. The editors' choices will be based on the quality of the essay.
Prizes and Odds: Two winners will be chosen in a random drawing from the 18 essays judged to be finalists on or about August 5, 2002. Winners will join a Courier-Post reporter and play all 18 holes listed in the editors' version of the "Dream Course". Limousine service, food and beverages will be provided by the newspaper. Winners must agree to play on a specific date and allow their names and photos to be used in a story. Odds of winning depend on the number of eligible entries received. Sweepstakes may be presented in multiple presentations and in other media and the odds of winning may depend on the number of eligible participants who enter the Sweepstakes through such multiple presentations. Approximate retail value $500.00.
Winner Notification and Acceptance: Winner will be notified by email on or about August 15, 2002. Return of prize notification as undeliverable or failure to respond by winner may result in disqualification and an alternate winner may be selected. Winner may waive his/her right to receive prize. Prize is non-transferable and non-assignable. No substitutions allowed, except that prize and individual components of prize package are subject to availability, and Sponsor reserves right to substitute prizes of equal or greater value. Winner is solely responsible for reporting and payment of any taxes on prizes. Winner may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of the postmark. Failure to sign and return affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, will result in a winner's disqualification, the forfeiture of his/her interest in the prize, and the award of prize to an alternate winner. Winners will also be announced on the Golf Page published in the Courier-Post on Thursday, August 15, 2002.
Participation: By participating, entrants agree to be bound by these Official Rules and the decisions of the judges. Sponsor reserves the right to disqualify persons determined to be tampering with or abusing any aspect of the Sweepstakes, as solely determined by Sponsor. In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering, or other causes beyond the control of the Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
Limitations of Liability: By entering the Sweepstakes, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in conjunction with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class actions, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain an award for, and entrant hereby waives all right to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
Construction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor, shall be governed by, and construed in accordance with the laws of the state of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of New York, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than New York. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with the terms as if the invalid or unenforceable provision was not contained therein.
General Release: By entering the Sweepstakes, entrants release Gannett Co., Inc and each of its respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents (including newspapers and websites), and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in conjunction with the Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
Sponsor: The South Jersey Dream Course is sponsored by the Courier-Post, whose decisions regarding the selection of winners and all other aspects of the Sweepstakes shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials, in print or electronic format, relating to this Sweepstakes.
